Terms and Conditions – Make a Bear
These terms and conditions apply to all offers, orders, and agreements of Make a Bear, both via the websitewww.maakeenbeer.beand through sales at markets, fairs, and events.
By placing an order or making a purchase, the customer declares to have taken note of these terms and conditions and accepts them.

2. Applicability
These terms and conditions apply to all agreements between Make a Bear and the customer, excluding any own terms of the customer, unless expressly and in writing agreed otherwise.
3. Offer and products
3.1. Make a Bear sells do-it-yourself stuffed animals according to the “Stuff a Bear at Home” principle. The products consist of separate parts that the customer assembles at home.
3.2. A standard stuffed animal package contains, unless otherwise stated:
- a stuffed animal skin with a closure system (zipper, strap, and/or velcro);
- filling to stuff the animal;
- a wish heart;
- a birth certificate.
3.3. Optional customizations such as sounds, scents, and outfits are offered separately.
3.4. The images on the website and promotional materials are as accurate as possible but may slightly differ from the actual product (for example, color or detail differences).
4. Prices
4.1. All listed prices are in euros and include VAT, unless stated otherwise.
4.2. Any shipping costs will be clearly communicated before completing the order.
4.3. Make a Beer reserves the right to change prices at any time. Price changes do not affect already placed and confirmed orders.
5. Order and formation of agreement
5.1. An agreement is formed at the moment the customer places an order and receives an order confirmation via email, or with immediate payment for purchases at markets and events.
5.2. Make a Beer reserves the right to refuse an order for valid reasons, such as suspicion of abuse, incorrect information, or unavailability of products.
6. Payment
6.1. Payment via the website is made through the offered payment methods.
6.2. For purchases at markets and events, payment can be made via electronic payment or other payment methods offered on-site.
6.3. The order will only be processed after receipt of full payment.
7. Delivery
7.1. Orders via the webshop will be delivered to the address provided by the customer.
7.2. Delivery times are indicative and not binding. Reasonable exceeding of a delivery time does not entitle to compensation.
7.3. The risk of damage or loss of products transfers to the customer at the moment of delivery.
8. Right of withdrawal (webshop sales)
8.1. The consumer has the right to withdraw from the agreement within 14 calendar days after receiving the product without giving any reason, in accordance with the Economic Law Code.
8.2. To exercise the right of withdrawal, the customer must contact us via email.
8.3. The costs for return shipping are the responsibility of the customer.
9. Use and safety
9.1. The stuffed animals are intended to be filled and assembled by the customer at home.
9.2. The customer is responsible for the correct and safe assembly of the stuffed animal.
9.3. Make a Bear is not liable for damage caused by incorrect use, careless assembly, or failure to follow any instructions.
9.4. The stuffed animals are not suitable for children under 3 years old, unless explicitly stated otherwise, due to possible small parts.
10. Liability
10.1. Make a Bear is only liable for damage that is a direct result of intent or gross negligence.
10.2. Liability is in all cases limited to the amount of the relevant order.
10.3. Make a Bear is not liable for indirect damage, including consequential damage, emotional damage, or loss of use.
11. Complaints
11.1. Complaints must be reported in writing via email within 7 calendar days after receiving the product, with a clear description and, if possible, photos.
11.2. Make a Bear will address the complaint as soon as possible and seek an appropriate solution.
12. Force Majeure
12.1. In the event of force majeure (such as strikes, pandemics, delivery issues, technical failures), Make a Bear has the right to suspend or cancel the execution of the agreement without compensation.
13. Intellectual Property
All texts, images, designs, and concepts of Make a Bear are protected by intellectual property rights and may not be copied or used without prior written permission.
14. Privacy
Personal data is processed in accordance with applicable privacy legislation (GDPR). Please refer to the privacy statement on the website for more information.
15. Applicable Law and Competent Court
Belgian law applies to all agreements. In case of disputes, only the courts of the customer's residence or the court of the place where the agreement is executed are competent.
